從過去將近70年的大法官釋憲歷史來看，雖然至今執行747件解釋，然而接近99%都是行書面審哩，沒有直接開庭的審理程序。而此次辯論，大法官提出四個爭點，分別如下：
Over the past 70 years, in the history of constitutional interpretation by the Justice, close to 99% of all 747 cases are reviewed in writings without the court procedures. Regard this year’s debate about same-sex marriage, the Justice proposed four points of contention. They are as follows.
1. 民法第4編親屬第2章婚姻規定是否容許同性別二人結婚？
2. 答案如為否定，是否違反憲法第22條所保障婚姻自由之規定？
3. 又是否違反憲法第7條保障平等權之意旨？
4. 如立法創設非婚姻之其他制度（例如同性伴侶），是否符合憲法第7條保障平等權以及第22條保障婚姻自由之意旨？
1. According to Civil Code Part IV Family Chapter II Marriage, are two people of the same sex allowed to be married?
2. If the answer is no, then is it against the protection of marriage freedom offered by Article 22 of the Constitution?
3. Is it against the idea of equal rights protection by Article 7 of the Consitution?
4. Does creating other non-marriage systems such as same-sex partnerships meet the requirements of the equal rights protection from Article 7 in the Constitution and marriage freedom protection from Article 22 in the Constitution?
針對以上爭議點的詳細說明，可以參考該篇文章，有挺同婚者，當然就有反同婚者，婚姻平權大平台指出，美國約翰霍普金斯大學公共衛生學院的學者2月時發表在《美國醫學會兒科期刊》的研究發現，在美國同性婚姻合法後的州，高中生自殺企圖相對於未合法的州低了7%，而性取向少數的學生自殺企圖更下降14%。

According to equallove.tw, a study from the public health scholars from Johns Hopkins University shows that in the states where same-sex marriage is legalized, the suicide attempt rate is 7% lower than in the states where it is not yet legal. The suicide attempt rate of students of sexual minorities also decreases by 14%.
然而，下一代幸福聯盟發言人曾獻瑩表示，同性婚姻合法並不會解決歧視的問題，因為在社會沒有共識的情況下，反而會增加社會對於同志族群的不諒解；此外，青少年自殺的原因，大部分是因情感跟人際關係的因素，跟同性婚姻並無直接關係。
Yet, according to hope.family.tw’s spokesperson, the legalization of same-sex marriage will not solve the problem of discrimination. Without a social consensus, doing so will only deteriorate the misunderstanding of the society for the LGBTQ community. Besides, reasons why teenagers commit suicide have more to do with emotional and personal problems than with the legalization of same-sex marriage.
